What is new about the duty to manage asbestos?
On the 21 November 2002, the control of asbestos at work regulations
2002 came into force. This places a new duty on employers to manage
the risks associated with asbestos by:
- Finding out if there is asbestos within the premises, its amount and
what condition it is in
- Presuming materials contain asbestos unless you have strong evidence
that they do not
- Making and keeping and up-to-date record of the location and condition
of materials containing asbestos
- Assessing the risk from the material
- Preparing and implementing a plan that sets out in detail how you
are going to manage the risk from this material
- providing information on the location and condition of the material
to anyone who is liable to work on or disturb it.
The deadline for all employers to comply with these new regulations
in full was 21 May 2004.
